MEcare4U will be referred to hereinafter as the "Service". We ask that you carefully read these Terms of Use ("Terms") before using this Service. By using and/or visiting this site, you express your agreement with these Terms and the terms and conditions of MEcare4U's Privacy Policy, which is incorporated by reference into this document. If you do not agree with these Terms, we ask that you do not use this Service.

General Information

The Service is owned and operated by MEcare4U (the "Company"). MEcare4U MD is a trade name under MEcare4U, based in Panama, at Ferrer Arias Street, Dos Mares, PH Elite 500, Apartment 8A. The Company reserves the right to review and modify these Terms at its sole discretion at any time without prior notice by updating this publication. We recommend that you visit this page periodically to review any changes. This Service is constantly being developed and modifications can be made at any time. Any changes to the Terms will take effect upon publication on this Service. If you do not agree with the Terms, your sole remedy will be to discontinue using this Service. Continued use of the Service after the publication of any changes constitutes your acceptance of such changes. By using MEcare4U, you consent to being contacted by MEcare4U to receive personalized medical information.

Reliance on MEcare4U Medical Evaluation

You acknowledge and agree that the opinion of MEcare4U is based on the best available judgment, according to the information you have provided, and should only be considered as guidance or an opinion on your medical situation, but not as a substitute for an in-person consultation with a doctor, which involves a proper review of your medical history, a physical examination, and the interpretation of diagnostic tests. You understand and agree with the role of the physician assistant and the nurse practitioner, and consent to being treated and receiving healthcare services provided by a physician assistant or a nurse practitioner working under the supervision of a licensed doctor.

Consultative Service

The purpose of the service offered through MEcare4U is to provide patients with access to additional information that they may or may not choose to use when planning their healthcare. This service does not replace in-person primary care. The services provided varies based on the patient's condition and residency status, with special emphasis on providing a medical opinion. In certain cases, the online nature of the service may make it difficult to verify a medical opinion (particularly in conditions that heavily rely on the doctor-patient direct interaction for an accurate evaluation). In such cases, the service will focus on evaluating or recommending treatment options.

The Service operates under a comprehensive care model. A physician assistant, medical assistant, nurse practitioner, and/or a doctor may contact you to assist with your health concerns. The healthcare services provided by a physician assistant or a medical assistant are performed under the direct supervision of a licensed doctor. Our healthcare providers do not prescribe narcotics, controlled substances, and/or abortion medications.

Limitations of the Service

No results can be guaranteed or assured when using this Service and receiving a medical consultation. Our healthcare providers may determine that this Service is not appropriate for some or all of your treatment needs, or that they are not authorized to provide the services you require, and may decide not to offer such services. Additionally, healthcare providers have the discretion to discontinue the medical consultation at any time and for any reason.

The service provided through this online platform differs from diagnostic services typically offered via in-person evaluation with a doctor. MEcare4U will not have the benefit of information that is normally obtained by examining you in person and observing your physical condition. Therefore, MEcare4U may not be aware of facts or details that could influence the medical opinion given. To reduce the risk associated with this limitation, the Company strongly recommends that an in-person medical examination be performed to complete the evaluation and treatment options. By choosing to use this Service without an in-person medical examination, you acknowledge and agree that you are aware of this limitation and assume the risk associated with it. You also agree and understand that: (i) the diagnosis you will receive will be limited and provisional; (ii) the medical opinion is not intended to replace a complete medical evaluation or an in-person consultation with a doctor; (iii) the healthcare professionals providing services through this Service do not have important information typically obtained through a physical exam; and (iv) the absence of a physical exam could affect the medical professional's ability to diagnose your condition, illness, or injury. You also agree that the medical opinion will not be used in any legal dispute, including, but not limited to, litigation, arbitration, disability benefit claims, workers' compensation claims, and/or malpractice lawsuits, without the prior written consent of the Company.

Medical Emergencies

DO NOT USE THIS SERVICE IF YOU ARE HAVING A MEDICAL EMERGENCY. IN SUCH CASES, PLEASE CALL 911 OR IMMEDIATELY GO TO THE NEAREST HOSPITAL EMERGENCY ROOM. IF YOU NEED GUIDANCE, YOU CAN CALL DIRECTLY AT +507 6980-7188.

Registration

To access this Service, you will be asked to register. As a registered user of the Service, you agree to accurately maintain and update any information about yourself that you have provided to the Company. If you fail to maintain such information, or if the Company has reasonable grounds to suspect that you have not, the Company reserves the right to suspend or terminate your account and access to this Service. You also agree to promptly notify the Company of any unauthorized use of your username, password, or any other security breach related to this Service by sending an email to doctor@mecare4u.com. Additionally, you agree to log out of your account at the end of each session. The Company explicitly disclaims any liability for losses or damages arising from your failure to comply with this section.

Service Security

This Service requires users to provide unique identifiers to access various areas of it. We use these identifiers to verify the user’s identity and eligibility, to protect our members from the unauthorized disclosure of sensitive or personally identifiable information. To protect the privacy of the data transmitted through this Service, when personally identifiable information is requested, we also use encryption technology (Secure Sockets Layer - SSL technology or similar) before transmitting it to us.

Additionally, the Company takes steps to protect the user data we collect against unauthorized access. However, you should be aware that this Service and our services are run on software, hardware, and networks, and any of these components may, from time to time, require maintenance or experience problems or security breaches beyond our control. You must exercise caution, common sense, and good judgment when using this Service. You are prohibited from violating or attempting to violate the security of this Service. Such violations may result in criminal and/or civil penalties against you. The Company may investigate any alleged or suspected violations, and if criminal violation is suspected, the Company will cooperate with the appropriate law enforcement agencies in their investigations.

Credit Transactions
The Company does not accept payments by check, money order, or insurance reimbursement at this time. The only accepted payment methods are major credit cards (MasterCard, Visa), online payment methods (PayPal), cash, and YAPPY (APP from Panama, Banco General). When paying by credit card, you authorize the Company to charge and bill the specified credit card in your order for any fees or other amounts corresponding to that order as they become due. By subscribing, you agree that the Company will automatically charge your credit card for future subscription renewals, unless you cancel your subscription one day before the renewal date. If your credit card expires or the Company is unable to debit the corresponding amounts, the Company will notify you and you must immediately provide a valid credit card number. Your service request will not be fulfilled until the full payment is received and/or verified.

Other Prohibited Activities
By using this Service, you agree not to:

  • Send or transmit any illegal, infringing, harmful, harassing, defamatory, threatening, hateful, or otherwise objectionable material through this Service;

  • Send unsolicited advertisements, requests, or promotions;

  • Impersonate your identity or affiliation in any way;

  • Restrict, discourage, or prevent others from using this Service, disclose personal information obtained from this site, or collect information about the users of this Service;

  • Gain unauthorized access to this Service, to other users' accounts, identifiable personal information, or other websites or computers connected to this Service;

  • Use automated systems, including but not limited to "robots," "spiders," or "offline readers," which access this site in a way that sends more requests to our servers in a given period than a human could reasonably generate using a conventional web browser;

  • Send or transmit chain emails, unsolicited messages, known as "spam" or "phishing," or advertisements for goods and services;

  • Post, transmit, or make available any viruses, worms, spyware, or other code, file, or program that may damage or hijack the operation of any hardware, software, or telecommunications equipment;

  • Violate any applicable law or regulation or these Terms;

  • Alter or modify any part of the Materials or services offered on this site;

  • Help or allow anyone to participate in any of the activities described above.

 

Intellectual Property Rights
The content of this Service, including but not limited to text, software, graphics, photos, sounds, music, videos, audiovisual combinations, patents, interactive features, trademarks, service marks, and logos, as well as any other materials you may view, access, or contribute to this site (collectively, the "Materials") are the property of the Company or are licensed to it and are subject to copyright, trademarks, and other intellectual property rights under Panamanian, foreign laws, and international treaties.
No Materials from this Service may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without written permission from the rights holder. You agree not to circumvent, disable, or interfere with the security features of this site or with features that prevent or restrict the use or copying of any Materials.
Modifying any Material or using it for other purposes is a violation of the copyright and other rights of the Company or other rights holders unless the Company or the owner has provided such Material expressly for that purpose. For any other use of the Materials, including reproduction, distribution of multiple copies, or use of Materials on another website or connected computer, you must obtain permission from the Company or the owner of the rights.

The Company is not responsible for the availability or content of these other websites, nor for any viruses or other harmful elements that may be found when accessing third-party websites. Furthermore, the inclusion of these links should not be interpreted as an endorsement or approval by the Company of the sponsoring organizations of these third-party websites or their products or services.

Interactions with Third Parties
Your interactions with entities or individuals found on or through this Service, including payments and the delivery of goods or services, as well as the terms, conditions, warranties, or representations associated with such exchanges, are solely between you and those entities or individuals. You should conduct whatever research you deem necessary before proceeding with any online or offline transaction with any third party. You are solely responsible for exercising caution and judgment in using this site and in disclosing your personal information.
You agree that the Company will not be responsible for any loss or damage resulting from such interactions. In the event of a dispute between users of this Service or between users and third parties, you understand and agree that the Company is not obligated to intervene.

Jurisdiction
This Service is controlled and operated by the Company from our offices in Panama. Those who choose to access this Service from other locations do so at their own initiative and are responsible for complying with local laws, if applicable.

Termination
The Company may terminate your access to this Service at any time and for any reason, without prior notice, if it is determined that you have violated these Terms. The Company will proceed to terminate the access of a user if, under appropriate circumstances, it is determined that they are a repeat infringer of third-party rights or have violated these Terms.

Disclaimer
The Materials of this Service are provided "as is" and without warranties, express or implied. To the maximum extent permitted by applicable law, the Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. The Company does not guarantee that the functions contained in the materials will be uninterrupted or error-free.

Limitation of Liability
To the maximum extent permitted by applicable law, under no circumstances, including but not limited to negligence, will the Company be liable for compensatory, punitive, special, or consequential damages arising out of the use or inability to use this Service or the materials contained within it, even if the Company has been advised of the possibility of such damages.

Indemnification
You agree to indemnify, defend, and hold harmless the Company and its directors, officers, employees, agents, and contractors from and against any claim, damage, loss, cost (including, without limitation, reasonable attorney fees), or other expense arising directly or indirectly from or in connection with (i) your breach of any provision of these Terms, or (ii) your activities related to this Site.

Children
This Service is not intended for individuals under 18 years of age. If you are under 18, please do not use or access this Service at any time or in any manner, unless you have been added as a dependent on a parent or guardian's account. By using this Service, you affirm that you are over 18 years of age. The Company does not seek to collect personal information from individuals under 18 through this site.

Dependents
You acknowledge and warrant to the Company that:

  • You and your registered dependents meet the local law requirements for the representation of your dependents and will continue to comply with such requirements when you request services from the Service;

  • You are authorized to act on behalf of your dependents and can make decisions related to their medical care;

  • You are using the Service solely for personal, non-commercial purposes.

 

Issuance of Medical Notes and Record Retrieval
The issuance of medical notes, including but not limited to permission request forms, medical certificates, insurance claim forms, discharge certificates, and any other requested medical documentation, will be subject to a non-refundable additional fee of $25 unless the plans to which you are subscribed include this service.
Additionally, the retrieval of medical records, including copies of SOAP notes, test results, or any other patient-specific information, will also incur a non-refundable additional charge. These charges are designed to cover administrative costs and the professional time involved in providing these services.

Automatic Subscription Renewal Policy
When registering for a subscription, you expressly acknowledge and agree that (a) your subscription will automatically renew, and the Company (or our third-party payment processor) is authorized to charge you on an annual, quarterly, or monthly basis, as applicable, for your subscription (in addition to any applicable taxes and other charges) as long as your subscription continues, and (b) your subscription will continue to automatically renew until you cancel it or the Company suspends it or ceases to provide access to the Service in accordance with these Terms.
The type of subscription, the current price, payment method, and next billing date will be confirmed in a confirmation email after your registration. You will also receive a payment receipt each time your registered credit card is charged. You can cancel your subscription by accessing the "Cancel Subscription" tab in the Settings section of the app. We reserve the right to change subscription prices or this Automatic Subscription Renewal Policy at any time at our sole discretion. If subscription prices or material terms of this Policy are changed, we will notify you by email before the change, and such change will not apply to previous subscriptions.

Subscription Cancellation and Refund Policy
At MEcare4U, we strive to provide the best experience possible to our clients when consulting with our doctors. However, we understand that circumstances may arise that require the cancellation of your subscriptions or a request for a refund. Therefore, we have established the following refund policy:
From this point forward, all subscription services provided by MEcare4U are considered non-refundable. This policy overrides any previous refund provision and is binding for all subscribers, both current and future, referred to as "Members."
This policy is based on the premise that resources, including but not limited to staff time, healthcare provider time, technological infrastructure, and service preparation, are allocated based on subscription commitments. Therefore, once the subscription or renewal payment is made, these resources are dedicated to continuous service provision, making refunds financially unfeasible. The Member acknowledges and agrees that once paid, subscription fees, including automatic renewal charges, are non-refundable unless expressly stated in this Policy.
Subscription renewals are subject to automatic billing at the beginning of each renewal period. The Member must cancel their subscription before the renewal to avoid being charged for the renewal. Subscription fees will be automatically charged to the payment method designated by the Member. The Member is responsible for ensuring that the payment information is accurate and valid. If a Member decides to cancel their subscription before the end of the paid period, they will still be able to access subscription benefits until the end of that period.
MEcare4U reserves the exclusive right to grant refunds under exceptional circumstances, at its sole discretion. Such determinations will be made on a case-by-case basis, considering the unique aspects of each request.
If a member wishes to inquire about a possible refund or discuss specific details related to their subscription, they should direct their communication to doctor@mecare4u.com. The request should clearly specify the reasons for the refund request. Upon receiving a refund request, MEcare4U will initiate a review process to determine eligibility for a refund. The decision made at the end of this process will be final and binding.
In cases where a refund is granted, the amount will be credited to the original payment method used by the Member. Processing of such refunds will generally be completed within 5 to 7 business days. Refunds will be issued to the original payment method.
MEcare4U reserves the right to modify, revise, or update this Policy at any time, with or without prior notice. By subscribing to the Services, Members expressly acknowledge and accept this Refund Policy. It is the Member's responsibility to familiarize themselves with the terms of this Policy.

Free and Discounted Consultation
From time to time, and as permitted by law, we may offer free or discounted trials of certain subscriptions for specific periods without the need for payment. If we offer you a free or discounted trial, the specific terms of your trial will be provided in the marketing materials describing the trial or at the time of registration. Free consultations are limited to one (1) consultation per person per day. Free or discounted trials are limited to one (1) per person.
Once your free or discounted trial ends, we (or our third-party payment processor) will begin billing your designated payment method on a recurring basis for your subscription (plus applicable taxes and other charges) while your subscription continues, unless you cancel your subscription before your free or discounted trial ends. Instructions for canceling your subscription are described above. Please note that you may not receive a notification that your free or discounted trial has ended or that the payment portion of your subscription has started. We reserve the right to modify or terminate free or discounted trials at any time, without prior notice and at our sole discretion.

Privacy
The use of this Site is also governed by the Company’s Privacy Policy.

Others
By choosing to visit this Service or provide information to the Company, you agree that the laws of the Province of Panama will govern any dispute over your use of this Service or these Terms. You also agree to attempt to mediate any dispute and comply with all liability limitations contained herein.
If any provision of these Terms is found to be illegal, void, or for any reason unenforceable, that provision will be considered separable from these Terms and will not affect the validity and enforceability of the remaining provisions.
